BELMOPAN, Belize -- Supreme Court Justice Oswell Legall on Monday dismissed a $2.5 million claim for breach of contract brought by Bella Vista Development Company Limited and Lopez Equipment Limited owned by Javier Berbey, and Wilhelm Lopez against the government of Belize.
The claim arose out of a contract signed by the parties on December 19, 2007, less than two months before the last general elections, for the construction of the Belize Sports Center at the Marion Jones Sports Complex located on Princess Margaret Drive in Belize City. The government of Belize had terminated the contract for its convenience on March 11, 2008.
The companies contended that they would have derived a profit of $2.5 million which represented 15% of the $16 million contract price.
Justice Legall also dismissed the government’s counterclaim against the claimants for repayment of money allegedly disbursed to the claimants as advance payment to initiate the project.
Godfrey Smith, former Attorney General of Marine Parade Chambers represented the claimants while Philip Palacio, Crown Counsel from the Attorney General’s Ministry, represented the government of Belize.
